What work will you perform?

As the Assistant General Counsel for Transportation Services, you will be responsible for providing information, advice, and legal assistance to all transportation logistics departments for all modes of transportation provided by the Company.  You will ensure compliance with all applicable laws, rules and regulations in an effort to limit and manage the Company's exposure to all types of risks.  The Assistant General Counsel has supervisory oversight of the legal services department within Landstar System Holdings, Inc. and its affiliate corporate holdings (the "Company").

 

 

Essential Responsibilities:

  • Regularly provide advice and counsel to the Company through its various officers and key managers to enable them to guide independent but affiliated businesses in a legally compliant manner that achieves unified goals of increased productivity and profitability
  • Draft and implement reasonable and effective Company policies and contracts and respond to legal issues and concerns as they arise
  • Review contracts with customers, vendors, contractors, employees and capacity providers and all other legal documents to manage the Company's risk and protect its financial security
  • Ensure compliance with legal authorities and government mandates focused on transportation and logistics matters and in responding to related legal issues before and as they become manifest
  • Provide assurance and specific advice to permit the business arrangements that need to be pursued, while acting within the law
  • Review and consult on:
  • Transportation and Logistics services including truckload, less-than-truckload, heavy haul/specialized, expedited, rail intermodal, air, ocean and warehousing
  • Risk management practices with the Company's Risk Management department
  • Safety and compliance practices
  • Claim issues (liability, cargo, workers comp, etc.); litigation involving the Company whether as a party or a non-party
  • Labor issues including independent contractor classification issues
  • International law issues principally focused on international freight transportation services, including with respect to cross-border US-Mexico and U.S.-Canada freight transportation services, and related customs and security issues
  • Environmental issues relating to emissions, transportation equipment and sustainability strategies, policies, reporting and disclosure
  • Provide preventative legal strategies that address long-term issues that could have far reaching implications to the Company
  • Retain, direct and oversee outside counsel performing legal work for Company
  • Investigate and resolve commercial disputes and oversee litigation with customers, BCOs, capacity, vendors and governmental agencies

 

 

Minimum Experience and Qualifications:

  • Juris Doctor Degree (J.D) or equivalent
  • 10 years of experience practicing law
  • 5 years of experience in transportation law
  • Licensed to practice as an attorney and counselor at law

 

 

Preferred Experience and Qualifications:

  • 2 years government contracting legal experience
  • 1 year of emissions and environmental reporting

 

 

Knowledge, Skills, and Abilities:

  • Strong oral and written communication skills
  • Timely and competent legal assistance in developing policies, contracts, plans and strategies governing the Company's customer, vendor and capacity relationships
  • Requires in-depth knowledge of long term strategic legal issues as they relate to long term strategic business initiative to methodically ensure decision making is made with sufficient background information, as it relates to issues of statute, regulatory and contractual compliance
  • Short-term legal trouble shooting and long-term strategic legal planning skills that include timely, thorough and capable reaction to each situation and request for assistance
  • Ability to develop policies, practices and strategies that are easily understood and accepted by all affected departments
  • Negotiation, conflict resolution and mediation skills
  • Handle escalated calls/issues regarding for resolution
